Benefits Terms & Conditions (Full Policy)

Entity: Entheos Audiology Cooperative, Inc. (“Entheos”)
Program: Member Advantage Program (the “Program”)
1) Scope & Acceptance
These Benefits Terms & Conditions (“Terms”) govern your participation in the Program. By accessing the Member Advantages page, selecting any benefit, or redeeming any credit (each, a “Benefit”), you agree to these Terms and the Entheos website Terms of Use. If these Terms conflict with vendor-specific terms for a particular Benefit, the more specific terms control for that Benefit.
2) Eligibility
Only current Entheos Members in good standing are eligible. Entheos may verify eligibility at selection and again at redemption.
3) Key Definitions
Benefit: Any item, credit, service, discount, incentive hearing aids allocation, or other advantage offered by Entheos through the Program.
Credit: A numerical or dollar credit that can be applied to a specified Benefit category (e.g., Marketing, Outreach Trip, etc.).
Selection Date: The timestamp when you finalize your choice in the Member Portal or via the official Entheos selection workflow.
Redemption / Use: Completion of all required steps to consume a Benefit (e.g., booking, placing an eligible order, submitting a redemption form, applying a credit, or receiving shipment/fulfillment), as specified for that Benefit.
4) Selection Window & Auto-Enrollment
If you do not select a Benefit (or combination of Benefits) within the stated enrollment window for a quarter, you will be automatically enrolled to receive Incentive Hearing Aids for that quarter (brand defaults to your prior-quarter selection, if any). Auto-enrolled Benefits are subject to the same 12-month expiry in Section 5.
5) Expiry (“Use-It-or-Lose-It”)
Once you select a Benefit, you have twelve (12) months from the Selection Date to use/redeem it. Unused Benefits expire at the end of that period, do not carry over, cannot be reinstated, and have no cash value.
6) No Carryover; No Cash Value; Non-Transferable
Benefits and Credits: (a) do not roll over beyond the 12-month window, (b) cannot be exchanged for cash, and (c) are non-assignable and non-transferable to other Members, affiliates, or third parties.
7) Redemption Mechanics & Proof
All selections and redemptions are recorded in the Member Portal. Entheos’ records (including logs and confirmations from vendors) are presumptive evidence of Selection Date and Redemption status. You should retain any confirmation email(s), invoices, or booking receipts as proof of timely redemption.
8) Vendor-Specific Terms
Some Benefits are fulfilled by third-party vendors and may have additional requirements (e.g., booking lead times, blackout dates, minimum order quantities). You must comply with those terms to redeem. If a vendor is unable to fulfill as described, Entheos may (at its discretion) provide a functionally equivalent alternative or credit.
9) Changes, Substitutions & Availability
Program features, available Benefits, vendor lineups, and quantities may change or become unavailable without notice. Entheos may substitute a substantially similar Benefit if a listed Benefit is discontinued or out of stock.
10) Member Responsibilities
You are responsible for (a) monitoring your account, (b) making timely selections, (c) completing all required redemption steps before expiry, and (d) ensuring your contact information is accurate. Entheos is not responsible for missed deadlines or lost Benefits due to non-use.
11) Exceptions / Extensions
Entheos may, but is not obligated to, grant written extensions for extraordinary circumstances if requested at least 30 days before the expiry date. Any extension decision is at Entheos’ sole discretion and may require additional documentation.
12) Fraud, Abuse, or Misuse
Entheos may audit Program participation and deny or reverse Benefits obtained through error, fraud, or misuse, and may suspend or terminate Program access for cause.
13) Taxes & Reporting
Benefits may have tax implications depending on your jurisdiction. You are responsible for any applicable taxes and for consulting your tax advisor as needed.
14) Privacy
Program administration may require sharing limited member information with vendors solely for fulfillment. Handling of personal information will follow Entheos’ Privacy Policy and any applicable data-processing agreements.
15) Happiness Enforcement Clause
If you have actually read these terms and conditions, email Nora Stewart at Nora@entheoshearing.com with the following: “Alan and Jim told me to email you after I read the Member Advantage Program Terms and Conditions. Make sure you let them know so I am eligible for a special prize.”
16) Limitation of Liability
To the maximum extent permitted by law, Entheos and its vendors are not liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the Program. Entheos’ aggregate liability for direct damages related to a particular Benefit will not exceed the stated value of that Benefit.
17) Modifications; Termination
Entheos may modify these Terms or terminate the Program at any time. Updated Terms will be posted on the website and apply prospectively. Continued participation after posting constitutes acceptance.
18) Governing Law & Disputes
These Terms are governed by the laws of the State of Indiana (without regard to conflicts principles). Venue and jurisdiction lie in the state or federal courts located in Allen County, Indiana.
19) Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
